Campaign Speech Essay

To our beloved beautiful, sexy and ever dynamic campus administrator Dr. Ma. Evengeline P. Perez, to the different chairs of different departments, to the faculty and staff of this institution, to my co-aspirants and to the best students of the whole world, a pleasant afternoon to each in everyone. We are convened here this afternoon for another remarkable and momentous activity in our lives as students, for this afternoon’s activity is considered as one of our greatest decision-making in our lives as students. A wise decision in choosing a leader who will serve as your voice and will hear and answer your queries towards your rights as one of the important stakeholders of this institution. My fellow Cenphilians, the man standing in front of you right now is an aspirant to become a leader, who had bore in mind that being a leader is not an opportunity to rule over the others nor to enslave other people. For me, becoming a leader is a great challenge and responsibility to continue the good administration done by the previous people in authority on the Supreme Student Government or otherwise known as the SSG. I being an aspirant leader of the said organization, would like to continue hearing your voices as what the previous administration did, in order that you can express and exercise your freedom of speech. And I as an aspirant, will serve as your stairway that your voices will be recognized as a student until everything will be okay. And as been said by a not so intelligent creature in the cartoon Spongebob Square Pants, â€Å"Everything will be okay at the end; if it is not okay, yet it is not the end† that is according to Patrick the Starfish. Yes this is really true my fellow cenphilians, and actually one of the reasons why I ran on this organization is that I want to encourage and influence everyone to pursue your dreams. If you haven’t ask me, I am one of the indigent students of this institution but still I am strong enough to overcome the challenges in life being a student. The courage I have in myself, forces me to ran as a leader, thinking that if God’s well, I can influence others in a positive way. And if ever I may not be lucky enough today, still I can assure you, you can still come on me for some motivations and advices, and I will never hesitate myse lf to help and comfort you in terms of your problems. Cause I ran thinking that I am not just be a leader but also will set myself as your â€Å"Manong† who is willing to guide and help you in terms of any unavoidable  difficulties in school or even outside the school premises (financially not involve). I can also be your friend for I am willing to render an extra ordinary services for the goodness of everybody that will enhance our personality for the betterment of the entire community. Lastly, I ran as a president on the SSG execom with a purpose of having a positive changes in our institution throughout my leadership to maintain our name on top, CPSU CAUAYAN UNIVERSITY CAMPUS, and I want that changes to be solicited from you. For I believe, as what a wise man says that, a good leader is always a good follower and yes Indeed. And if ever I became a leader, I want a fair treatment to every students, and being a president in God’s well is not my only chance but everybody’s chance to express your thoughts and ideas for the betterment of the campus, because hopefully, I Arjay T. Bando a 3rd year BEED student, is an open-minded, trustworthy and approachable person is ready to serve you my fellow Cenphilians with all my heart and up to the best that I can. Agreed ways of working Essay

The agreed ways of working are set of codes by the employer for the social care worker to conduct and inform service users and the public about the standards of conduct they can expect and includes legislation, practice standards and employers’ policies and procedures that should be met. It is the responsibility of social care workers to work within the policy guidelines and following the laid –down procedures and ensuring that their conduct does not follow below the standards set out and that no action or omission on their part harms the wellbeing of service users. The importance of having full and up-to-date details of the agreed ways working. It is the requirement of the organisation to adhere to relevant legislation and to form their policies and procedures in respect of new legislation changes .e.g. Equality act 2010 is a fairly new act so necessary that it must be reflected in the organisation’s policies and procedures. To ensure the safety and well being of service users, staff and the public. To ensure staff are clear on their duties, roles and responsibilities and can carry out their job in the right way. The needs of service users change, staff members change, staff skills and abilities change so support plans, guidelines and risk assessments must reflect this, to help providing a service that the individual needs, as set out in their care plan are met. To ensure continuity of care and to prevent misunderstanding and confusion. It’s important that all information is relevant and up to date.

Formal Analysis of Statue of Eros Sleeping

The statue of Eros sleeping is one of the key attractions in the metropolitan museum collections for the lovers of ancient Greek history. A glimpse at the magnificent work of art takes one away, far back in time to the Hellenistic age. Clearly it is one of the most remarkable works in the Metropolitan Museums total collection. The statues sculptor is not known but the time of its making has been correctly identified. Moreover historical studies have revealed much surrounding the statue of Eros as a sleeping baby. The Bronze Statue of Eros Sleeping dates back from the 3rd century B.C. to the early 1st century A.D.Recovered from the Rhode Island, the statue is one of the few surviving bronze art pieces from the Greek period to have endured the test of the centuries in an almost flawless state. [1]The statue, which measured 85.2 cm in length, is displayed in the Greek wing of the museum. Undoubtedly, the Bronze Statue of Eros Sleeping is noteworthy not only for physical aspects but also for its iconographic significance in art history, particularly in understanding Greek culture of which the statue was once a part of.The ability of the statue to last for so long shows its sculptors determination to make a lasting piece that he no doubt meant to preserve the cherished culture of the time. The Greek bronze sculptures that were made at the time were complexes of geometric forms that resulted in the making of peculiar sculptures that distinguished the Greek culture. The sculptures of the Greek were different from the sculptures of the other contemporary cultures such as the Romans culture.According to carol C. Mattusch, who is a leading authority in the study of the Greek ancient bronze sculptures, the bronze sculptures that were made at the Hellenistic period were made with a certain design that the artists intended to carry a specific message. In the case of the gods sculptures the link with the people was the power the gods were believed to have over the people. In th e case of the statue of Eros sleeping there was no particular buyer but it was meant for the people of the Greek region as a whole.[2]In its location in the Metropolitan Museum, the Bronze Statue of Eros Sleeping commands the viewer’s attention by being a freestanding figure that makes it stand out in the empty exhibition space. It is best seen from the frontal angle, where the viewer has a full view of the entire statue. The statues composition also demands that it be seen from a small distance in order to get a full sense of the effect of the statue against its surroundings.Taken on its own, the Bronze Statue of Eros Sleeping presents an exemplary case study of the rendering of human forms in Greek Art. Here, the artist displays a keen knowledge of the material, and is able to take advantage of bronze as medium in making the statue as life-like as possible as it gives the statue a sense of fluidity and movement. On the other hand, bronze also enables the statue to gain a sen se of mass and weight, which is appropriate to the figure of Eros in deep slumber. Likewise, the bronze medium allowed the artist to manipulate the natural qualities of the medium to create the human form. The medium of bronze is a powerful agent for the recognition of the immediate environment in which the Greek people in the Hellenistic period lived. It helps make a symbol potent of both religious and secular values. As one of the few bronze statutes that have survived from the antiquity it is an enduring icon of the naturalistic detail of the age. The result of the presence of such a statue is history in the firsthand. The statue is deemed to have had a base that was carved out of stone in place of the support it lies on in the museum. The base, just like the statue, would probably be a rendition of comfortable material in work of art just as befits the sleeping baby deity. As a god of love he was deemed to have such qualities as bodily comeliness and to be the bearer of graceful d eeds. The child image would not be a symbol of the god of love without the addition of wings to the statue. The statue of an innocent child in slumber with curled hairs and other details of a well fed child would be too plain for a god. Greek gods were believed to be spirits that had wings that were useful for them to fly from one destination to another.Clearly, the artist was able to engender movement by using forms that complement the use of open lines. Hence, one of the most notable aspects of the statue is the use of organic forms that mimic the natural curves of the human body to depict the cherubic appeal of a healthy child. There is also evidence that the artist considered the influence of light on the statues composition. For instance, Eros face is only partially exposed to the light, which gives him an air of mystery as half of his face is hidden in the dark. The retention of the mediums color also gives it the contrasts in hue created by the natural play of light on the stat ue.[1] Hemingway, Sean. 2007. See below - Coursework Example Bait and switch becomes unlawful when the seller is not able to or declines to offer the advertised commodity to the buyer, does not avail required quantity of the commodity to the customer, or fails to deliver or commit to deliver the commodity within a reasonable time after an order is placed. In the case however, there is no sale of goods scenario between the shop and the sales personnel and no advertisement at a low price with the aim inducing the other party to a more expensive product. Further, the commission rate does not relate to customers. The situation, therefore, does not identify an unlawful bait and switch (Emerson 253). Set 2- b The case involves a college scenario in which a worker discovered money during a mass clean up. The college offered lockers to students but decided to do a clean up before changing its allocation arrangement for efficient record keeping. Students were asked to clear their property from their respective lockers but cleaners found some things, ma inly old and discarded items, in the lockers. While cleaning, Frank, one of the workers, discovered a small paper bag and found cash amounting to $ 10000 in bills. The college has demanded for the money while frank claims right over the cash and it is believed that the cash could be related to drug sales. The matter to be determined in the case is potential issues for identifying the party with a right over the money and involves whether the money is lost, mislaid, or abandoned property, and the difference between the concepts. The concept of lost property is identifiable and offers a solution to the rightful owner of the money. A property is termed lost if the owner â€Å"negligently, carelessly, or inadvertently leaves it† at a place (Cheeseman 792). In the case, the owner of the cash, presumably a student, was negligent because the institution adviced students to clear all their property from the lockers. Even though owners of some lockers could not be identified, the scho ol is not the owner because it did not know of the property’s existence and could have removed it of notified cleaners of its existence. The concept of lost property that confers ownership rights to whoever discovers a lost property. The money is therefore a lost property and Frank gains ownership (Cheeseman 792). Set 3- a Jake and Kate are members of a limited liability company that is member managed. Jake is a member of a three-person management team while Kate is not. The two are however actively involved in the management and entered into a contract on behalf of the company, each placing $ 1000 as deposit but the management team refused to ratify the contract. Members of a limited liability company have rights and obligations of the members. As a member of the management team, Jake has a right to operate and create contracts on behalf of the company while Kate has no right to engage in any activity on behalf of the company. The two members however have rights to be indemn ified for payments made on behalf of the company. Both members have obligations to be loyal to the company, and to ensure duty of care to the company. In addition, Jake had an obligation to perform fiduciary duties (Cheeseman 662-665). Set 4- a Lorna operates a sole proprietorship business but the enterprise has a separate name, telephone numbers, and account number. She operates the business as a separate entity from her personal life and has stated that the business

Leverage and capital structure chapter 13 solutions Essay

Leverage and capital structure chapter 13 solutions - Essay Example Total leverage reflects the combined impact of operating and financial leverage on the firm. High operating leverage and high financial leverage will lead to high total leverage. The following equation explains the relationship between the degree of total leverage and the degrees of both operating and financial leverage. Poor capital structure decisions can result in high cost of capital, thereby lowering the NPVs of projects. On the other hand, effective capital structure decisions can lower the cost of capital leading to higher NPVs thereby increasing the value of the firm. All the items on the right hand side of the balance sheet, excluding current liabilities are sources of capital. The firm’s capital structure directly affects its financial risk, which is the risk to the firm of being unable to cover required financial obligations. The more debt and preferred stock a firm has in its capital structure, the greater its financial leverage and risk. The penalty for not meeting financial obligations is bankruptcy. Managers of firms typically act as agents of owners. The owners give the managers the authority to manage the firm for the owners’ benefit. The agency problem created by this relationship extends to the relationship between owners and lenders. Lenders can control the firm’s risk and protect themselves against adverse effects of the agency problem by including appropriate provisions in loan agreements. On the other hand, firms benefit by obtaining funds at lower costs by agreeing to the financial and operating constraints placed by loan provisions. A signal is a financial action by management that is believed to reflect its view of the firm’s stock value. Generally, debt financing is viewed as a positive signal that management believes the stock is under-valued while a stock issue is viewed as a

Dwight D. Eisenhower Leadership and Management Paper Research

Dwight D. Eisenhower Leadership and Management - Research Paper Example Management is not just confined only to organizations. Even political leaders need to have the knowledge and skills of a good manager in order to be successful in their careers. One leader with such qualities is the 34th president of the United States, Dwight David Eisenhower who exhibited both managerial and leadership qualities. This paper looks at  Eisenhower’s qualities as both of a leader and a manager. Characteristics of a Good Manager A number of factors define a good manager. The ability to have a vision about the future means that a manager is future oriented. A good manager needs to show enthusiasm in his/her work as well as to have the ability to empower and motivate others to work enthusiastically. The decision making process of a manager should be defined by an ability to make quick and informed decisions. Words need to be backed by actions. Managers who talk too much by issuing orders rarely succeed in their careers as workers need to see how they can perform t asks as well. Characteristics of a Good Leader A manager should be a good leader which means that he possesses good leadership skills. A good leader is proactive and thinks about the future. They are flexible in their decisions and actions so they can easily adapt to any change that may arise. A good leader has good communication skills, and respects the subordinates. Confidence in both leading the team and believing in personal decisions is an important quality of a good leader. A good leader shows enthusiasm in work. The interest in the feedback from the subordinates is a concern for efficient leaders, while they exhibit good organizational skills and delegate duties to the subjects (Leatherman, 2008). Leadership and Managerial Qualities of Dwight D. Eisenhower Eisenhower exhibited both leadership and managerial qualities in a number of ways. Having been a leader of the army during and after the First World War, he exhibited good leadership qualities by heading the army in war. At the onset of World War I, he immediately requested for an assignment overseas. This showed how dedicated he was in his job, showing one of the qualities of a good leader. As a hard working military man, he rose over the ranks to become Lieutenant Colonel in the National Army. As Lieutenant, he exhibited good organizational skills. He was able to organize members of the army during the war and draw placement programs of the personnel. His ability to approach members of the lower ranks and deal with them showed his commitment to the staff and his ability to effectively communicate with all the people in the military regardless of their position. His skills as a visionary leader were portrayed when he remained focused on the role of tanks in any war that would follow after the First World War. He showed his high level of commitment to his job patiently rising through the ranks of the military to become General of the Army Air Force. His dedication to work let him succeed in many assig nments such as in the invasion of Sicily. To promote democracy, he accepted the role of the President of Columbia and NATO Supreme Commander. His dream of becoming a president of the United States was supported by many people who felt that he had good leadership qualities suitable for the success of the United States. He chose to continue with Roosevelt’s plan of the New Deal for the United States and, thus, won a second term which

Comparative - Essay Example This paper exemplifies various similarities and differences between â€Å"Drunken Master† and â€Å"Fist of Fury†. Firstly, both films are nationalistic and portray the Chinese masculinity. Nationalism and Chinese cinema have always been intertwined. â€Å"Fist of Fury† is situated at the period when China was recovering from degradations and humiliations in the hands of Japanese and other colonial powers. Lee acts as a strong Chinese man who confronts all humiliations and challenges and triumphs over them thus portraying his nationalism. Lee defeats Japanese clearly indicating the triumph of Chinese martial arts over external forms and illustrates how customary martial arts were deeply ingrained in Lee. Additionally, Lee’s triumph and devotion to defending the society is depicted when he uses his Chinese martial arts skills to defend and protect his community against external interference, a factor that further indicates the role that men were supposed to play in the traditional Chinese community. While many analysts document Lee’s nationalism as hugely controversial and th e entire process of defining who a Chinese is as multifaceted and dubious, Lee’s character embodies a Chinese who is anti-Japanese and the avenge against the slaying of his master portray the antagonism that existed between Chinese Nationalists and the ‘others’, typically represented by Japanese villains (Louie, 92). Similarly, in the â€Å"Drunken Master†, the nationalistic spirit and Chinese masculinity are featured through the character of Jackie Chan. Chan, despite being dreadful of Chinese martial arts, is forced to train in it which later enables him to defend his father against being butchered by Yan Ti San who was hired by a business opponent to kill Chan’s father. Chan was to be trained by Beggar who is legendary for crippling students when training. When Chan finds it hard to survive in Beggar’s school, he leaves for Drunken Master’s school and learns

2012 Efforts to remove evolution from textbooks in South Korea Case Study

2012 Efforts to remove evolution from textbooks in South Korea - Case Study Example This announcement and step by government in collaboration with creationist group has been greeted with criticism by the biologist and the entire scientific fraternity in South Korea and also they have support from some theologians who reason that simply learning the evolution theory does not mean that the students will follow and believe in it. With the removal of the evolution theory, students will only learn about creation theory which coincides with the large population of this nation being Christians. It will also narrow down the view of the world since its inception by the students and they may find it hard later on in life when they leave the country and start interacting with scientists all over the world who still hold dear the evolution theory. Creationism is therefore viewed as the only theory and hence becoming more powerful and acknowledged even

The future of Nuclear Medicine - Research Paper Example Nuclear medicine provides Pico molar understanding and exclusive tracer specialty in the in-vivo learning of human pathophysiology for example intake of glucose, somatostatin expression and tissue perfusion. (Peter, 2002, 630) In contrast to anatomic imaging technology nuclear medicine has made great strides in the expansion of new radio-pharmaceuticals but has made little progress in imaging devices. One can define a Nuclear medicine technologist as an expert health care professional, who plays a fundamental part in the field of nuclear medicine or molecular imaging department and find ways to diagnose and treat illnesses. (Peter, 2002, 638) A nuclear medicine technologist works together with doctors, patients, nuclear pharmacists, computer experts, nurses and a number of other health care personnel. In some cases they may keep a direct contact with the patient; where they arrange, standardize and administer radiopharmaceuticals to the patient; they may also carry out different types of imaging procedures with the patient; for example, they may control imaging, lab and computer instrumentation; and looks after radiation protection of the surroundings. Technical progress in technologies such as ultrasound and multidetector CT are remarkable. Harmonic imaging of native tissue (without added contrast) with ultrasound is an example of this. Harmonic imaging detects the second harmonic of the transmitted ultrasound pulse rather than imaging the fundamental frequency. Harmonic imaging provides better contrast than fundamental imaging. Harmonic imaging has been applied to the heart to enhance delineation of lesions and perfusion. Strauss (2007) compared harmonic ECHO (with added echo contrast) to myocardial perfusion imaging with 99mTc–sestamibi at rest and pharmacological stress. In addition to ultrasound improvements in multidetector X-ray-computed tomography has made CT angiography a standard practice and enhanced the

Academic Degree and Financial Aid Essay Example for Free

Academic Degree and Financial Aid Essay Thank you in advance for taking the time to review my letter of appeal for financial aid reinstatement. First, let me say, I wholeheartedly appreciate your granting me this award in order to make my educational dreams a blissful reality. It would be a great honor for me to continue on the path which I started before I suffered this temporary setback. I take full responsibility for why my grades slipped and because unsatisfactory. There is no one else to blame but myself for not being able to control my emotional state during a time of terrible crisis to the point where I could maintain an acceptable G. P. A. For that I am sincerely sorry because I feel that I have let many people down, including myself. I put a lot of effort to pass most of my classes, yet I still failed my English course due to some negligence on my part as concerns my work which was to determine my grade in the course; I did everything possible to do great in the course despite my mistakes but I guess it was not good enough during the semester Fall 2013. I promise not to make such mistakes anymore, and be more responsible. I am asking this committee to give me a second chance to prove that I am worthy of this award so I can continue in my studies this Fall 2014 Semester. I do realize that I neglected my studies and I would like another chance to do better in them. I have compiled a list of steps I need to take in order to be successful in school and my studies. 1. I would obtain a tutor for my most difficult classes by becoming familiar with the tutoring center on campus 2. I would manage my time wisely so that I can balance my life and studies together. 3. Meet with each of my instructors and talk with them, about what they believe will make me be a better student in their class. 4. Go to the scheduled office hours of each of my instructors, when facing any difficulties. 5. Talk with my advisor who is assisting me with my Academic Degree plan. She advises me on the classes and hours that would be suitable for me. 6. Go to class on time as scheduled to take advantage of what they have to offer. My goal is to earn a degree in business so I can make a difference in the lives of people and young students. This is very important to me because I’ve always been interested on being a business lady in the future during my days as a kid. I can only be able to achieve my goal if my financial aid is being appealed, because as an individual my family face a lot of financial difficulties and I’m not able to pay my tuition or even get my books. I am a hard working student and very determined, and I would like the chance to prove to you that this 2014 Fall Semester would not be a disappointment. I would try hard to be a good role model to my family, friends and other students. My education is of paramount importance to me. Thank you for your time Yours Sincerely, Ruth Taku.

Comparison Essay Example for Free

Comparison Essay Both of Emily Dickinson’s poems are about death. â€Å"Because I Could Not Stop For Love† is more about the cycle of life than death. â€Å"I Heard a Fly Buzz When I Died† relates to the final moment before death. Emily Dickinson’s poems are both centered on death; â€Å"Because I Could Not Stop For Death† is based more around upbeat and happy scenes, as where â€Å"I Heard a Fly Buzz When I Died† talks about the preparation before death. Although both poems have very different meaning, the two poems both focus on the ending of life. In the last line of â€Å"Because I Could Not Stop For Death† Emily Dickinson says were toward eternity. In Dickinson’s second poem it says, now she waits for the king to come. In the first poem Dickinson refers to eternity meaning after death living for forever. In the second poem waiting for the king to come relates to the end of existence, when the king comes back to take us all. In â€Å"Because I Could Not Stop For Death† has a happy ending and is a very appealing poem. Dickinson describes a girl being picked up in a carriage for all of life’s journeys. Where Dickinson’s second poem was a serious poem, describing the build up right before death. She mentions the stillness in the air, and breath-gathering firm. One poem is very heart warming and, the other is very serious. These poems ultimately have the same meaning, but both take a different look at death. The first poem contains the process of life before death, and how she is working for a new beginning. Dickinson’s second poem talks about her death being the end of everything, Dickinson even mentions decaying in the grave. The first poem has a positive outlook on death, and the second portrays a rough end to life.

The Ntsb And Icao In Accident Investigation Engineering Essay

The Ntsb And Icao In Accident Investigation Engineering Essay This paper provides a report on the National Transportation Safety Board and the International Civil Aviation Organization and their contributions to aircraft accident investigation. Brief histories of the two organizations along with a few highlighted events are provided. The NTSB and ICAO in Accident Investigation The NTSB, Americas legendary investigative body, is charged to find causes for transportation related accidents and make recommendations. ICAO, an agency under the United Nations jurisdiction, is charged to promote and standardize international aviation throughout the world. The purpose of this paper is to look into these important two organizations and see how they contribute to the aviation industrys accident investigation abilities. First, let us get familiar with the NTSB and ICAO and learn a little bit of their histories. NTSB History National Transportation Safety Board has an interesting history, which shaped the organization into the well-respected investigative body we know today. In 1926, Congress passed the Air Commerce Act of 1926. The act charged the U.S. Department of Commerce to form an investigative body to research and report on aircraft accidents. In 1940, the Civil Aeronautics Boards Bureau of Aviation Safety was created. This newer agency took over the responsibility of aircraft accident investigations. In 1967, the Department of Transportation was created and NTSB was established to be an independent agency under the umbrella of the DOT. The NTSB is charged to investigate accidents in aviation, ground transportation, shipping, railroads, and pipelines. The NTSB also investigates accidents involving hazardous material transport. In 1974 Congress moved the NTSB out of the DOT to make the agency independent citing, No federal agency can properly perform such (investigatory) functions unless it is tota lly separate and independent from any other agency of the United States.. The NTSB has performed over 132,000 aviation and thousands of surface transportation accident investigations. The agency is on call 24 hours a day, 365 days a year. The NTSB on occasion has been invited to other counties to assist with their aircraft accident investigations. (History of The National Transportation Safety Board, n.d.) Now that we have a basic understanding of who the NTSB is as a government agency, we can transition over to the history of ICAO. ICAO History People outside of aviation know little about the International Civil Aviation Organization. According to ICAOs website, the International Civil Aviation Organization (ICAO) was created by the United Nations, in 1944. Their purpose is to promote safe, secure, and sustainable development of civil aviation with the cooperation of the United Nations Members. (International Civil Aviation Organization, n.d.) To this day ICAO still strives to meet and exceed their goals established back in 1944. Around two years ago, ICAO had declared its strategic objectives for 2011-2013. ICAO would like the members of the United Nations to continue to support the agencys standards and recommendations, to promote a better international civil aviation environment. ICAO desires that everyone can operate to the level where optimum safety, security and sustainability can be achieved. ICAO has three strategic objectives. First, Enhance global civil aviation safety. Second, Enhance global civil aviation security. Finally, Foster harmonized and economically viable development of international civil aviation that does not unduly harm the environment. (International Civil Aviation Organization, n.d.) ICAO, the UN backed agency, could be better compared to the United States Federal Aviation Administration (FAA) or and other nations equal. However, unlike the FAA, ICAO lacks the ability to enforce regulations and dictate policies. The FAA has the power to enforce the FARs and levy penalties. Unlike the FAA, ICAO has, on rare occasions, conducted aircraft accident investigations and submitted reports in accordance to its own Annexes. The two aviation disasters, that ICAO investigated and reported, worth mentioning are the 1973, Libyan Arab Airlines Flight 114 and 1983, Korean Airlines Flight 007. Libyan Arab Airlines Flight 114 Libyan Arab Airlines Flight 114 was ICAOs first accident investigation. This disaster occurred during the 1973 Yom Kippur War, between Israel, Egypt, and Syria. There were 108 fatalities resulting from the Israeli Air Force shooting down of the Boeing 727. According to the Aviation Safety Network, an internet database developed for the Flight Safety Foundation, the following events occurred. Libyan Arab Airlines Flight 114 was traveling from Benghazi, Libya to Cairo, Egypt. On the aircrafts approach to Cairo weather became a huge factor, due to the amount of heavy cloud cover. The aircraft strayed off course into the Sinai desert and into Israeli occupied air space. 2 Israeli Air Force fighter jets intercepted the civilian airliner and tried to get it to land. Libyan Arab Airlines Flight 114 did not comply with the fighter jets request and tried to return to Egypt. The Israeli fighter jets shot down the aircraft forcing the pilots of Flight 114 to attempt a belly landing, in the dese rt. Upon impact, the airliner burst into flames and all were killed. ICAO conducted the investigation and reported the Cairo beacon was probably not functioning at the time of the event. The approach control radar was out of order too. (Aviation Safety Network, n.d.) ICAO was tasked to investigate the aircraft accident, by the United Nations, since Israeli-Arab relations were non-existent. The neutral party conducted its investigation, interviewed involved parties and drew out its causes and recommendations. It would be ten years later, that ICAO would have to assume the accident investigator role. This time an incident involving the United Sates and the USSR, who are deeply entrenched in the Cold War. Korean Airlines Flight 007 Based on this researchers exploration, the 1983 Korean Airlines Flight 007 incident was the first time where the NTSB and ICAO interacted directly with each other. According to the Aviation Safety Network, the following events occurred to KAL-007s demise. Korean Airlines Flight 007 was flying from New York City to Seoul, Korea, with one stop in Anchorage, Alaska. After being refueled in Alaska KAL 007 began its final leg to South Korea. The part of the trip would run along Soviet borders and air space. This was a normal route for aircraft traveling from North America to Asia. During this time, the Soviet Military were conducting tests in this region and USAF RC-135 recognizance aircraft were conducting operations. The USAF presence would prompt a Soviet fighter response. KAL007 unintentionally was flying in and out of Soviet airspace, which warranted a fighter response. The Boeing 747 airliner did not respond to the Soviet fighter pilots warnings. The fighter pilot was instructed to shoot-down the unresponsive aircraft. The fired missiles damaged the aircraft, causing a massive decompression of the airliner and causing the jet to crash into the ocean. (Aviation Safety Network, n.d.) Since Korean Airlines Flight 007 originated from the United States, the NTSB jumped into action to begin their investigation of the accident. It was their legal obligation to perform the investigation, but the U.S. State Department squashed the NTSB and made a formal request to have ICAO conduct the investigation. The State Department and the Reagan Administration did not view this event as an aviation accident but as a civilian aircraft downed by the Soviet Air Force. This would be ICAOs second aircraft accident investigation, since the 1973 Libyan Arab Airlines Flight 114. Perhaps a neutral party was appropriate for the situation, but ICAO has no authority to demand participating countries to provide evidence. ICAO could only ask for voluntary information only. According to an FAA journal, Transportation Certification Update, Summer 1995, in 1992 ICAO, the NTSB led a delegation to the Russian Federation during the AIG/92. The purpose of the trip was to develop a consensus to improv e the content within Annex13 and improve that accident investigation process. In 1993, ICAO with the NTSB reopened the investigation on Korean Airlines Flight 007. (FAA, 1995) With the Cold War ending in the late 1980s and early 1990s, ICAO was finally able to acquire additional information to present a more acceptable report for the KAL 007 investigation. ICAO and the NTSB were able to see declassified documents, and research additional evidence that prior to the end of Communism would not have been possible. However, even today there are dozens of websites and books that believe there is a more sinister story behind the 1983 Korean Airlines Flight 007 disaster. NTSB FedEx 1406 The NTSB as an agency possesses a legendary amount of experience and accomplishments, but they are also human too. The inflight fire of Flight FedEx 1406 comes to mind. . According to the Aviation Safety Network, FedEx 1406 was traveling from Memphis, Tennessee to Boston, Massachusetts when the smoke detectors within the cargo bay systematically activated. The smoke detectors, on the upper deck, activated in the following sequence 9, 8, 7, 10, and 6. The crew was able to land safely at an airfield in Newburgh, New York. The aircrew evacuated safely, but once the compartment hatches were opened, the aircraft erupted in flames. The firefighters were able to extinguish the fire but the aircraft was a total lost. The fire, that burned inside the cargo hold penetrated through the fuselage and cutting the tail section off the aircraft. (Aviation Safety Network, n.d.) The controversy with this accident was that the NTSB and the National Fire Protection Association (NFPA) could not agree with the source and origins of the inflight fire. Both the NTSB and the NFPA had vast amounts of data to back each others claims. According to Walters Sumwalts book, Aircraft Accident Analysis: Final Reports, the air carrier had no idea about the nature of its cargo. The NTSB had recommendations for both the FAA and the Department of Transportation. Today all persons sending out mail packages or cargo must declare their contents to ensure these items are properly packages and positioned for transportation. This was one accident where nobody involved died and major improvements to cargo transport were implemented. The NTSB and the NFPA could agree on the fire but lives are being saved from the lessons from this accident. (Walters Sumwalt III, 2000). Conclusion In closing, the NTSB and ICAO have kept their promises in promoting and maintaining a safe and secure aviation industry. It is unfortunate that the aviation industry is inherently reactive and needs aircraft accidents and disasters to prompt changes. The FAA and Congress use the recommendations, from the NTSB, to enact improvements and change laws. Sometimes airlines and aircraft manufactures still drag their feet when complying with the newer standards. Today aviation is the safest mode of transportation. Organizations like ICAO, the FAA, the NTSB, and their counterparts provide tremendous service to the citizens of the world. These agencies along with strict regulations make air-travel, as humanly possible, universally safe and secure.

JEdgar Hoover :: essays papers

JEdgar Hoover J. Edgar Hoover was a young 25-year-old when he became the acting director of the Federal Bureau of Investigations. His first federal job was as a clerk in the files division, and he quickly became one of the most respected and feared men in the free world. Even presidents knew better than to cross him. A consummate politician, Hoover was one of the first to ride the â€Å"media train† to power. He used the media as a tool and he knew that what people read and what they see and hear directly affect what they think. A brief biography, as an introduction to the man will aid us in the understanding of who he was, and through this we may gain incite into the reasons for why he did the things he did. Hoover was born New Years Day 1895 in Washington D.C. the youngest of three children. He had an older brother and sister that lived and an older sister that died as a baby. His mother, Annie Hoover had the greatest influence on him as a child. She was strong willed and militaristic in her approach to raising her children and running a family. She instilled in him a strong sense of right and wrong, and taught him the work ethic for which he would live by. Hoover was a winner, during his school years and beyond. As a boy Hoover was afflicted with a speech impediment. He was so determined to overcome this handicap that he read aloud for hours a day until he no longer stuttered. Hoover was short and slight in stature but he was athletic and quite agile. He was a member of his high school track team that went all-American. He was on the debate team and did quite well. This is probably where he got his combative nature. He was also the captain of his ROTC company in college. Giving him the leadership skills that he would need in later years. Hoover graduated near the top of his class from George Washington University with a bachelor’s degree in Law. (Powers, pp.48-52) With all of this going for him one might expect him to join the army as an officer as other men his age were being drafted to war, but as sole provider for his mother he was exempt from the draft. He also got his first taste of federal service when his uncle got him a position as a clerk in the files office of the Department of Justice.

Hasbro, Inc. Essay -- GCSE Business Marketing Coursework

Hasbro, Inc. Business Organization and Management Corporate Profile The twentieth century, especially the past fifty years, has certainly been a time of enormous change. Products have changed, the business of manufacturing and marketing toys has changed and the needs and desires of consumers who buy toys have changed. The majority of the world’s toys are now manufactured in the Far East. Perhaps the greatest change in the toy industry has been in the way that toys are sold by incorporating creative and original marketing strategies into company culture. It was Merrill Hassenfeld who broke new ground in 1951 as the first manufacturer to advertise a toy, Mr Potato Head, on television. It didn’t take long to realise the value of appealing directly to children. Today the sophistication of branded toys that can extend from a film to a series of toys and onward to computer software and electronic games might seem incredible to an earlier generation of toy makers. Yet the fundamental values of the toy industry are the same as they have always been. Subsidiaries and Divisions Atari - Manufacturer of coin-operated and consumer video games. Formed in 1972. Foreign studies: Chinatown Essay

Extreme traffic congestion and crowding cerate an aggressive atmosphere (cp. fig. 7.2.1.8). Thus, experienced atmosphere carriers like colourful shops, Chinese pharmacies, exotic market places (cp. appendix A fig. 21, 22), the picturesque Binondo Church (cp. appendix A fig. 23) come not fully into one’s own due to the disorganized surroundings. Numerous untidy areas with visible garbage, filthy canals, fetid sewers and dilapidated heritage buildings are discouraging and leave a lasting memory of neglect and insufficient cleanliness (cp. fig. 7.2.1.8 and appendix A fig. 24). Prevailing monotonous (dark) grey colouration is perceived as oppressive. The activity spectrum refers mainly to education or shopping with guided tours or through self-exploration. Stimuli are mainly audio-visual, olfactory (spices) and food tasting The district is perceived as complex, with numerous confusing pathways. The orientation is difficult due to missing signage, brochures and absent references to landmarks. Inner district attractions (e.g. market places, temple) are not signposted and difficult to find while on self-exploration. Main attraction elements like Binondo Church, authentic Chinese historic shop-houses, exotic Chinese pharmacies, authentic restaurants, hidden spiritual places are not tourism oriented accentuated and staged for visitors. Unbearable crowding supports a feeling of insecurity. The district offers numerous catering facilities and shops but public restrooms are unavailable. Interconnectivity to adjacent sites (Escolta, Rizal Park, Intramuros) is conveniently within walking distance. The plan was to build a huge bargain shopping place that would dwarf all the popular thrift, wholesale haunts in the neighborhood. Three years hence, and what rose on one whole block on Reina Regente Street in the heart of Binondo has indeed eclipsed every structure in its vicinity. But it wasn’t the discount behemoth originally planned that opened last February, but a posh, multilevel mall that this side of town had never seen before. â€Å"We took a risk,† said Kevin Tan, first vice president and Commercial Division head of Megaworld Corp., the developer of Lucky Chinatown shopping mall. â€Å"Chinatown is a known bargain area, but midway we felt that we ought to do something different, one that’s never before seen in this area.† The five-level Lucky Chinatown, interconnected by bridge walkways to Megaworld’s twin-tower residential condo, Cityplace, has a supermarket, four cinemas, a food court, an appliance center, a kids’ zone, a fashion zone, and a host of dining, service and retail shops previously seen only in upscale malls in Makati. Tan’s father, real estate tycoon and Megaworld CEO Andrew Tan, always wanted to build something special for the Binondo of his childhood, according to Teresa Pesigan-Valentino, Megaworld’s AVP for marketing and business development. The 3-hectare location of Lucky Chinatown is considered a heritage site where two public high schools, Rajah Sulayman and Josà © Abad Santos, used to be. (When Megaworld acquired the property from the Manila city government in 2008, the developer relocated and built new structures for the two schools, also in Manila.)

What can you learn about Roosevelt from this Source?

What can you learn about Roosevelt from this Source? Explain your answer, using details from the source. (6 marks) One thing that I think you can learn from source A about Roosevelt is that he was clearly a kind and caring man. Although Source A has been taken out of context it is clear that the writer of this letter thought that Roosevelt was a very fine president. From source A we can assume that the writer of this letter was having difficulties and was having trouble extending his mortgage so he wrote to the president asking for help. We can then assume that the President sent a letter in reply saying that he will send one of his workers or acquaintances to try and help the man/ woman get their house/furniture back for them. This shows that Roosevelt was very considerate and did not set himself back from the ordinary people of America. With acts like these, he inspired the American people and gave them courage throughout the Depression and Second World War. Though there are many things that can be learnt from source A about Franklin D. Roosevelt, there are still important things that cannot be learnt. We cannot learn whether the writer of this letter previously knew the President or find out who he or she was. Another important thing that we cannot find out from source A is the precise facts of what went on, i.e. was the house gong to be repossessed? Or what were his or her financial details? Without this information, it is hard to find out whether Roosevelt would have been as generous to everyone as he was to this person. Question 2 – Study sources B and C How far do these two sources differ in their view of Roosevelt as president? Explain your answer-using details from the sources and your own knowledge. (7 marks) Sources B and C differ in many ways. For example, one is anti-Roosevelt, and one is pro-Roosevelt. The cartoons were both drawn in the mid-1930's but source C clearly attacks Roosevelt while source B is optimistic and shows that Roosevelt is trying to remove the bad and clean America up. These sources are both cartoons that are opposite and show the views that were circulating at that time. Source B shows that the treasurer is counting the cost of this clean up and shows that FDR is ready for work as his sleeves are rolled up, and portrays him as a very dedicated president. The cartoon for source B shows FDR carrying out his promises, one of these were to take ‘action and action now!' Roosevelt worked alongside the Brain Trust, which was a group of experts, which passed new laws; one of these was called ‘The New Deal'. America's economy was in such a state that Roosevelt was given emergency powers and with these he carried out his three aims which were: Relief, Recovery, and Reform. Roosevelt was prepared to provide a large amount of Government money to relieve the poor but to raise Government money taxes had to be raised and this, along with many other factors, is why the rich did not like FDR. In the mid-1930's the newspapers were not in support of FDR, neither were businessmen and the Republicans, this was because they thought for one, that the New Deal would be making people lazy, and certain people would just depend on Government help and handouts. They also did not like the New Deal, as it was the well off that had to pay for the Social Security of their workers. Source C differs from source B completely, as source C shows the taxpayer's money is being completely wasted and that all of the money that is getting put into the New Deal is not giving a just return. It shows that the actual New Deal has flaws in it that make the New Deal dysfunctional, whereas source B is pro-Roosevelt and shows that he is cleaning up the mess that President Hoover left America in. Source B shows that FDR is getting rid of all of the promises and things that Hoover was unable to carry out and things that were associated with Hoover. Source C and Source B can be seen as the rich and the poor people's views at this time of American history. Source C as the rich and Source B as the poor and those affected by the Great Depression. Source B shows that FDR is clearing the old (bad) and making way for the new (good). He is giving moral to the citizens by showing them how to forget the past and to focus on the future. The sources differ, and another way of explaining this is the way in which source B states the year that the cartoon was drawn and says who it was by, whereas source C shown the cartoon and assumes that it was drawn in the mid 1930's but does not say who by. Question 3 – Study sources D and E Which source is more reliable on the popularity of Roosevelt as president? Explain your answer, using details from the source and your own knowledge. (8 marks) The source that I think is more reliable on the popularity of Roosevelt as president is source E, I think for the following reasons. Source D is written by Roosevelt himself and shows his view on the previous government and what they did not do. He says and acknowledges that the previous government was dysfunctional and says that America had to go through nine years of allusions that Hoover and his government put forth. Roosevelt says that ‘powerful influences' (businessmen, rich and Republicans) are still trying to bring back the old government that ‘failed' and did not care for the ordinary people of America. This is probably because they did not have to pay as much money for Tax and did not have to pay for the Social Security of their workers. FDR states that government by organised money, i.e. rich businessmen, is as dangerous as decree by ‘thugs'. He says that it is the first time that he has been hated by these united forces, but he welcomes their hatred. Source E was written by a Republican opponent of the New Deal that clearly damned the New Deal. He says the deal is taking away far too much of ‘their' money (the tax-payers) in an attempt to reap equality he also says that this is a defiance of all the ideas upon which our civilisation has been founded. He also says that the cautious with money are being taxed while the lazy poor simply inherit. I think that source E is the most reliable source to see how popular was, because it is written by an opponent to FDR and his laws but still says how much FDR is helping to ‘relieve, recover and reform' those badly affected by the Great Depression. By doing so, it proves that those affected by the Great Depression and those left jobless were greatly helped by Roosevelt and were very fond of him as a president, whereas the republicans and the rich businessmen did not like him at all. So, taking into account that almost everyone in America was affected by the Great Depression and were looking for a president that would help them out, FDR would have been extremely popular with the general population, excluding the rich, which were at this time a minority. Source E, as written by an anti-FDR citizen shows this, which is why I have chosen source E as the most reliable source. Question 4 – Study sources F and G Which source is more useful for assessing the success of Roosevelt's New Deal? Explain your answer, using details from the source and your own knowledge (8 marks) The source that I think is more reliable on the popularity of Roosevelt as president is source G, I think for the following reasons. Source G shows a table that illustrates the performance of the US economy during the 1930s and from this chart it is clear to see some very important facts about the great depression and how it affected the labour force and the unemployed people of America in the 30s. It is very useful because you can easily see the evidence and Information of the facts of the depression and what the new deal achieved. Source G is more useful than the other source because it shows how successful the new deal actually was, it also allows us to see how much unemployment was reduced and was the new deal actually achieved. Source G shows us that that when the Second World War occurred countries were in high demand of manufactured goods and that is how America was lifted out of the depression. It also shows us that the graph on source G shows us that the new deal continually needed money to be pumped into it in order to stop the situation getting any worse and hopefully improve it. Source F shows us that the new deal made many citizens happy. Therefore source F shows us how successful the new deal was at gaining popularity from the cartoon, though this is not reliable evidence and a cartoon on the from of an NRA song book can not prove to us that that was the impression of Roosevelt though we can speculate. Source F shows us popularity and is not particularly accurate as it was an artist's impression and the artist that drew the cartoon would have been commissioned so they would have been made to embellish. Source F is not really an accurate source to analyse Roosevelt's success. It is not useful because it just shows people marching and shows Roosevelt's popularity with the people. The two sources show two different types of success of the new deal. but. Source F shows us how successful the new deal was but it is not useful like source g.. Source F does not show us how successful the new deal was it just shows us that it had popularity†¦ Source G therefore shows us more things and is therefore more useful and it is more reliable than source f. Source G shows so much more than source F and is therefore more useful in showing how successful the new deal was and what it achieved. Question 6 – study all of the sources and use your own knowledge. The following are two different views of Roosevelt: (i) He was a great leader, who inspired his country More sources support the interpretation that Roosevelt was a great leader than that he was an inconsistent president. The evidence that supports the interpretation that Roosevelt was an inconsistent president was unreliable. Source C is attacking the New deal. This source is unreliable because many of the newspaper owners were hostile to Roosevelt. Source E is also attacking the New deal but his is unreliable because an opposition of Roosevelt wrote it and it was written at a time when Roosevelt was unpopular. Also sources J and I are attacking Roosevelt but these are also unreliable. From this I can say that the evidence that says that Roosevelt was an inconsistent president is unreliable. From the evidence that suggests that Roosevelt was a good president there are still unreliable sources. An unreliable source A because it could have been written by anyone who supported Roosevelt. Source B is an inaccurate source because we do not know who Drew the carton. Source d is also unreliable because Roosevelt himself wrote the speech. Source F is unreliable because people who supported Roosevelt drew it. But Source G is reliable because it is a government document and therefore unlikely that it would be inaccurate. Source H is reliable because an historian wrote it and therefore the historian would have a balanced opinion because he would have analysed lots of evidence and he was not intimately involved with the depression. From this there are two pieces of evidence that are reliable and support the statement that Roosevelt was a great leader. The best-supported interpretation is that Roosevelt was a great leader, who inspired his country, relieved poverty and distress and dealt with the depression in an imaginative way.

Mcdonald’s in India Essay

McDonald’s in India McDonald’s uses a multidomestic strategy in India. This can be seen from its use of local suppliers, its adaptive pricing strategies and the removal of the company’s representative product, the â€Å"Big Mac†, and replacing it with a range of new products specifically catered to the Indian culture and preferences. Unlike in other countries, a large proportion of Indians do not eat pork or beef, and many others are vegetarians. It is therefore practically impossible for McDonald’s to succeed with its international line of products such as the big Mac, which focuses on beef products. Moreover, with each household spending more than 50% of income on food and beverages, and more than 70% of the population earning less than $2,000 annually, the company’s usual target segment of the middle-class households is unable to afford its products. Hence, it can be seen that McDonald’s needs a high level of responsiveness and adaptation to the Indian market. In addition, the company opted to enter the market as joint ventures with local managers, clearly showing no need of global integration, but rather, emphasis on local adaptability. Attractiveness of the Fast Food Industry in India Factor Conditions in India Indian Culture Affecting the Demand of Specific Foods Inefficient Food Chain and Distribution Systems Chance Government Policies Porter’s Diamond Model Attractiveness of the Fast Food Industry in India Factor Conditions in India Indian Culture Affecting the Demand of Specific Foods Inefficient Food Chain and Distribution Systems Chance Government Policies Porter’s Diamond Model McDonald’s strategy is highly effective in India. McDonald’s success thus far in India is attributable to the factors as analysed in Porter’s Diamond Model. An important factor for the success of McDonald’s was its reliable distribution channels for supplies from local suppliers. As the food chain and distribution channels in India were inefficient, and imports were taxed at a staggering 65%, it was important that McDonald’s obtain its raw materials from local suppliers, but at the same time ensure that the supplies were of good quality, and were delivered efficiently. This would be necessary to ensure that the company maintains a high standard of quality, while at the same time ensuring low costs of production. Given the state of the agricultural industry and the high import taxes in the country, setting up a reliable distribution channel for McDonald’s creates a valuable resource that is rare, costly to imitate, and non-substitutable. It hence creates a sustainable competitive advantage for McDonald’s in India. Another important factor of success is the pricing adopted by McDonald’s. Unlike in other parts of the world, the consumers in India are highly price sensitive to food, since more than half of their income is spent on food. Thus, it was important that McDonald’s sets acceptable prices for their products in India. This was not an easy task, as the company had to set a price that was affordable to the Indians, but at the same time, not undercut its profit margin. Hence, the company relied heavily on local management for the operations of the business. Not only did it enhance the company’s responsiveness to the local needs, it also allowed the company to understand the culture of the Indians better. Fitting the company’s values into the culture of the country is especially crucial to the survival and success of McDonald’s in India, since the very nature of food products McDonald’s deals with may conflict with the cultural beliefs of Hindus, who make up the majority of Indian population. Besides seeking out opportunities, McDonald’s has also successfully dealt with the threats, especially those of the environmentalist groups. As there were many vocal environmental and animal activists in India, they posed a substantial threat to the company’s business. Further, these groups also campaigned that fast-food joints were anti-poor and cater only to the rich segment. This was especially threatening to the company, since the majority of Indians were not well-to-do. In response, McDonald’s products were aptly priced to be affordable to the general public. In addition, they introduced healthier products (such as the toasted McCurry Pan), an also actively participates in many community-involvement programmes, which are largely directed towards children. Since India is in the stage of population growth, the proportion of children is especially high. This strategy hence allows McDonald’s to increase its popularity amongst households with children. Moreover, it also fits well with McDonald’s culture of focusing on children. While McDonald’s strategy in India has been effective thus far, there are challenges it continues to face. Currently, McDonald’s is situated only in a few metropolitan cities, where the crowds are more familiar with American products, and are willing to try these products. However, with the development of India, McDonald’s has to expand to other cities to reach out to the rest of the nation. With the highly regional culture of the country, it has to continuously develop its products which are able to cater to the unique preferences of the consumers. This is important to the company’s continued success in the country. Besides, the company also has to ensure that it continues to garner political support. As the country has many activists groups and extremist religious groups, it is important that McDonald’s has the support of the government in order to ensure that the operations are able to continue in times of chaos.

Explain the Success and Failure of Constitutions

Constitutions can be defined in a variety of different ways. Duchacek , in 1970 described constitutions as â€Å"power maps†, in which the formal powers of the state are described and distributed. A more explicit definition can be gauged from Robertson , who describes the constitution as, â€Å"a set of rights, powers and procedures regulating the structure of, and relationships among the public authorities and between the public authorities and the citizens. † This long definition is condensed by Watson , who describes constitutions as the â€Å"rules of the political game† and â€Å"the laws that govern the governors. Constitutions usually have come into existence to facilitate a â€Å"fresh start† following the demise of the past regime via revolution, independence, or a change in society. Constitutions are not infallible and can fail if the conditions are right; those conditions will be discussed in this essay. According to Hague, Harrop and Breslin , a successful constitution is â€Å"one that does not attempt too much†. They point to the American constitution as an example. The US Constitution created a limited central government because that is what was deemed necessary. If the constitution created a stronger central government, it may have gone against the interests of the more independent minded states and individuals who would have opposed such a move. A constitution, which delegates and separates powers amongst the governing institutions apparently, coins success. The most well known example of this would be again the American constitution. The legislature (Congress ), executive (the President ) and the judiciary (the Supreme Court ) is separated by the Constitution, providing constitutional independence and delegating various powers. The Constitution insures that no one institution has more power than the other, preventing a power struggle within government that could lead to its destruction. However, to explain the success of constitutions in terms of the balance of powers would ignore the success of the â€Å"unwritten† British Constitution. The British Constitution, where power lies supremely with the government, the legislature, cannot be regarded as a failure. The success of this constitution could perhaps be explained by its flexible and articulate nature, which allows gradual change. A good example of this in practise is the enfranchisement of Britain, which took almost a century to attain. The Government introduced this necessary legislation following the changes in society. Without this change, Britain's Constitution would have failed to meet the needs of the people, and fall in the face of popular revolt. Even supposedly rigid, written constitutions can respond to changes in society, an important property if that constitution is to succeed. In the United States, judicial constitutional interpretation plays an important part in placing a constitution written over two hundred years ago into the context of the modern day. Chief Justice Hughes' statement; â€Å"We live under a constitution. But the constitution is what the judges say it is. † This may not be wholly accurate, but judicial interpretation has been an important factor in the continual evolution of the American Constitution, which encouraging its success. Finally, the success of constitutions can be attributed to the economic factors within the state. Germany and Japan have for the past fifty years possessed successful constitutions, which can, to a degree be attributed to their very strong economies. Following the Second World War, the allies, by buoying up the economies of these two nations, prevented them from falling to the short-term problems, such as nationalism and communism. This move subsequently ensured their long-term constitutional success. A constitution that has failed its purpose is one that fails to provide adequate rules of government, which can lead to either an inefficient government, or a government that abuses the governed. There are a number of reasons that governments fail. If Hauge, Harrop and Breslin's reasoning concludes that a successful constitution is one that attempts little, it follows that a constitution doomed to failure is one that attempts too much, allowing no room for interpretation or change. A poor constitution would not allow the judicial interpretation that allows the American constitution to develop, or allow a flexible constitution like the British to change wit the introduction of new legislation. The Constitution of Italy, the Guarantisimo prevents the reoccurrence of a dictatorship. However, the various checks and balances created by the constitution, such as a strong bicameral legislature, and regional autonomy have led to ineffective government, and the loss of popular support among the people. This is one example of the separation of powers going to far, hindering the constitutional process. A constitution that fails to take into account the social, economic and political factors within a society will very rarely succeed. Evidence of this can be found in the failure of the post-colonial constitutions imposed on former colonies during the 1950's and 1960's. Countries such as Britain and France attempted to impose constitutions that were based on theirs. Unfortunately, the peoples of Africa and Asia were not used to democracy, their cultures were based upon autocratic rule, not liberal, democratic government. Many of the fledgling governments fell, as single rulers, often helped by the military filled the vacuum. Countries whose democratic governments survived, for example India and Pakistan experienced the move toward strong centrally controlled government, undermining the democracy the constitution represented. It is often not the constitution that fails, but the regime that facilitates the change because it is weak, and cannot remain in office for too long a period. The constitution may succeed in providing the checks and balances of power, but if the regime lost the support of the military, there would then be scope for change Constitutions are not always liable to succeed; the above examples indicate that. A successful one allows change, can be interpreted by the judiciary and is assisted by a healthy economic climate. A failure is doomed to be ineffective because it is too restrained, and not allowed to change as society develops. Explanations for the success and failure of constitutions can be diverse, particularly in today's global society; the reasons above are only a selection of wh at can constitute a constitutional success or failiure.

Lehman Brothers Failure Questions Essay

Having taken part to the events occurring in this scenario only in a few occasions, and as the ultimate guarantee of rescue, the FED,in conjunction with FDIC and the Office of the Comptroller of the Currency, made decisions aimed to save those institutions, for instance AIG, Fannie Mae and Freddie Mac, whose failure would have had a greater impact on financial system’s wealth and perspectives of recovering from the crisis were reliable. This was the main reason for declining any proposal of action in favor of Lehman. Some argued that the company’s bankruptcy was an intentional choice rather than a â€Å"genuine error†, aimed to induce the restoration of higher degrees of financial discipline. However, had the government disposed a plan in favor of Lehman Brothers, this would have prevented investors from losing faith towards financial institutions, the financial system from freezing and economy from carrying the weight of the crisis Notwithstanding, further attempts to save Lehman Brothers did not came to completion for several reasons, not only due to Government stillness, but the giving out of other financial actors i. . Bank of America and Barclays. In an ultimate analysis is thus important to consider that the â€Å"unfair† practices were not carried on by the sole Government, but by all financial institutions acting in the system as a whole: every actor placed a risky bet, whose consequences seem difficult to be addressed to just one responsible. Do you think that the U. S. government should have allowed Lehman Brothers to fail? Although Lehman Brothers was the fourth-largest U. S. investment bank, it was seen by many analysts as the weakest of Wall Street’s biggest firms. It is plausible therefore to think that the government willfully took the decision to let it go bankruptcy, in the purpose to restore a certain degree of indipendence from the market, and serving as threat for other institutions preventing them from adopting hazardous behaviours. The government decision of non-intervention had immense costs both in terms of financial losses inflicted to the credit market operators and institutions, and of lost in confidence in the market itself, that eventually turned into terror and paralyzed the credit market worldwide. Indeed investors’ confidence in th market and general concerns about the security of the banks continued to plumb during Lehman Brothers’ stock value erosion and afterwards. Nonetheless, consequences from Lehman Brothers’ bankruptcy had spread in a broader sense affecting all clusters of stakeholders: for instance, it could be mentioned the forced lay off of up to 1,500 people, which amounted to about 6 percent of Lehman’s work force. With hindsight, the decision of the US Government to allow such a giant as Lehman to fail is difficult to support, especially considering the devastating negative impact it had in a long-term perspective. Almost no objection that it should have been a critical decision to take at that time. It indeed brought the evidence that the financial market needed a shock, which unveiled some crucial problems and send a clear message to the banking system, proving that â€Å"too big to fail† companies were likely to face collapse as well, though no one would have believed this before. Many experts argue that when the government bails out a private financial institution it creates a problem called â€Å"moral hazard,† meaning that if the institution knows it will be saved, it actually has an incentive to take on more risk, not less. What do you think? Moral hazard, or, in other words, the willing of companies to act recklessly, bearing large risk exposure, has the consequential effect of distorting competition, thus mitigating risk perception and allowing excessive risk-taking, which is ultimately transferred from financial institutions to the society as a whole. This had been a controversial argument , largely discussed in the light of the financial crisis of 2008. The core of the debate was to what extent did moral hazard caused the crisis, and to what extent did government’s guarantees of rescuing perpetuated an hazardous behavior among market players. The moral-hazard argument is not only due to eventual interventions from governments, but is increasingly being considered by expertise as an inner element of a company’s strategic policy, drawing the shape of the decision making process in the interest of the company itself. However, corporate decisions are rather made in the interests of individuals than for the company as a whole, which causes a loose the connection between those interests and the company’s long-term health assumption. The possibility to gain short term benefits, at a relatively low cost, leads to reckless behavior regardless of eventual bails out from governments, with long term costs that hardly find responsibles to pay them back. One key factor is indeed limited liability, which allows investors and executives, ultimately liable for companies’ decisions, to enjoy the benefits of their risk-taking, while eventually limiting their exposure. The Government is responsible for contrasting moral hazard practices and maintaining investors’ confidence in the stability of both financial and economic activity, ensuring that the system don’t suddenly shut down in a panic. It can happen that, indeed, the expectation of further intervention from regulators and politicians may be an incentive for hazardous practices itself. However, moral hazard is an intrinsic disease of corporate strategies, thus of the financial market, whose antidote only relatively depends on government rescuing hand upon financial institutions. Scandinavian Airlines System 1998 Case Study Example | Topics and Well Written Essays - 3000 words

Scandinavian Airlines System 1998 - Case Study Example Jan Carlzon has undoubtedly initialized changes, which caused a dramatic turnaround in the overall business operation of the airline system. These changes were carried out in response to the problems that beset SAS and the entire airline industry as a whole. These changes were also geared to adapt to the rapidly changing external environment and trends in the transportation sector. Among the new strategies implemented by SAS during the presidency of Jan Carlzon was focusing on the business traveler. The airline has evolved as the "businessman's airline, " offering an excellent service to full-paying business traveler through the introduction of "EuroClass" that provides more amenities than the other business class airlines at the level of the old economy fare. This was further strengthened by the improvement of flight schedules and punctuality. To provide a more attractive schedule, Eurolink was also created for short distance routes. Scanorama which feature lounges for the exclusive use of full-paying class were also introduced by the company in order to further different and highlight the luxury offered to the business traveler. In order to completely execute the new strategies, SAS has undergone a corporate cultural revolution, which was a deviation from the company's focus on resources and technology. There had been a restructuring which involved decentralization, education, and empowerment. A second wave of strategies were c... SAS has banked on its aim of being "a full service, door-to-door, travel service company," and "offer a unique product which we could control from A-Z." These have lead to the introduction of SAS International Hotels, SAS Reservation System, Credit Cards, SAS Service Partner, other related activities such as publishing and advertising, and a new group structure. We can see that in SAS major reforms, Jan Carlzon made use of both prescriptive and emergent strategies. According to Richard Lynch (2000), prescriptive strategies are those whose objectives have been defined in advance while emergent strategies refer to those strategies which has unclear objectives and whose components are developed during its course of life. As the case presented, the company has tailored its strategies to suit the changing needs of its market (Lynch, 2000). Prescriptive strategy was used in order to take into account the rapidly altering socio-cultural trends in the airline industry, thus the utilization of the socio-cultural theories of strategy. According to the case, the focus on business travelers was due to the fact that full-paying business travelers comprise the largest chunk of the airline's revenue yet the total number of passengers serviced was declining. This was prompted by the change in preferences of travelers as they seek more value for their money and change in lifestyle, which necessitated them avail service when their need arises. We can trace these changes to the transformation in the socio-cultural aspect of the European community. As the economy was facing a recession, maximization of customer's purchasing power was a priority. Also, the demands of being an executive left a busier

God does not Play Dice but Science does Research Paper

God does not Play Dice but Science does - Research Paper Example Before the Big Bang our cosmos was no bigger than the size of an atomic nucleus. Science explains that since then the universe has been expanding at a steady rate (John, 1997). It was Edwin Hubble in 1929 whose observations confirmed this assumption. Although the cosmos is expanding, no one knows what it is expanding into. The laws of science could explain the initial conditions of the universe but would fail to clarify the reason because of which the universe began. Before the Eighteenth century, it was believed that such questions belonged to the realm of metaphysics or religion. Today such an approach is widely considered preposterous as science in the 21st century could unravel the most astounding mysteries. Our perceptions of space and time have been greatly influenced by theories including Einstein’s general theory of Relativity, Newton's theory of gravity and largely by the Quantum theory. Einstein's special theory of relativity, which was later modified as the general theory of relativity and Newton's theory are classical theories. Their implications proposed that space and time were a fixed background. Time was like a long track stretching in only two directions. Einstein found innumerable difficulties when he tried to reconcile his special theory with Newton's theory of Gravity. He eventually resorted to the conclusion that space itself was curved and it was not separate from time. He highlighted the fact that gravity had distorted everything in space. Objects in space would try to move in a straight direction but their paths would appear to be bent. It was thus evaluated that due to sun's mass space-time would curve which bends the path of the planets. Space-time could be defined as the four dimensional space whose each point is an event. Einstein's General theory of relativity which further stated that the laws of science should be same for all observers was confirmed in 1915, approximately ten years after the acceptance of the special theory of relativity. Now one might wonder that reality could be stranger than fiction because the laws which govern cosmos can shape reality in the most unusual fashion. It is inevitable to ignore these complex notions if we are to develop an understanding of space and time from a scientific angle. The discovery of Quantum mechanics in 1926 was one of the greatest achievements ever for science. Einstein was partly responsible for its discovery but Max Planck played the major role. The word 'Quantum' has been derived from 'Quanta' which means packets. Quantum physics deals with the study of sub-atomic particles and according to many scientists this theory has brought an element of uncertainty in modern physics (Michel, 2006). An important concept which forms the basis of Quantum theory is the Heisenberg's uncertainty principle. It states that one cannot accurately determine the velocity and position of a particle simultaneously. If you would try to measure a particle's location accurately , then you will not be able to determine its actual velocity. Einstein had earlier suggested that light consisted of particles known as 'photons'. He thus explained how electrons in a solid body would be dislodged if light fell on it. It should be noted that Quantum mechanics function on a very small scale but it remains a significant part of Science. However Richard Feynman's theory without which the Quantum theory is incomplete can be applied on a larger scale. According to its principles every event or

ASEAN Free Trade Area Essay Example | Topics and Well Written Essays - 500 words

ASEAN Free Trade Area - Essay Example The AFTA agreement aims at promoting free trade in the region by bringing down the tax barriers and making the trade related policy framework to be more encouraging. The agreement can be understood as a kind of regional liberalization of trade policies that are favorable for boosting regional trade. Further the article focuses to find out whether if formation of this agreement has created trade creation or trade diversion. Trade creation can be considered as a development whereas trade diversion from the non member nations to the member nations can not be considered as a positive development. An important instrument for applying the trade agreement in the total region is the Common Effective Preferential Tariff scheme that requires the tariff of certain commodity to fall below zero to five percent. These commodities include capital and non capital as well as manufactured goods. This process of liberalization and eliminating the identified commodities from taxable commodities has been phased out in for phases. This has been done in order to prevent any instantaneous impact over the respective national economies of the member countries. A gradual tariff reduction would assure that the change shall be absorbed over a period of years and thus promote trade. After fifteen years of the agreement, it can be observed that the countries have largely succeeded in achieving the goals.

COMPARE THE UNITED STATES BILL OF RIGHTS TO THE ENGLISH MAGNA CARTA OF Term Paper

COMPARE THE UNITED STATES BILL OF RIGHTS TO THE ENGLISH MAGNA CARTA OF 1215 - Term Paper Example The second amendment is the right to keep and bear arms. This amendment guarantees citizens the freedom to protect their life against oppression of the government by keeping arms (Burgan 38). The third amendment states the conditions for quarters of soldiers. These conditions state that citizens cannot be forced to have soldiers enter their houses whether during war or during peace (Burgan 39). The fourth amendment is the right of regulated search and seizure. This amendment guarantees citizens the right to have their places and possessions searched or seized only against a warrant issued under due cause (Burgan 39). The Fifth Amendment concerns provisions concerning prosecution. This means that the citizens cannot be prosecuted unless a Grand Jury finds it legitimate to do so. Citizens should also not be compelled to testify against themselves (Burgan 39). The sixth amendment secures citizens the right to a speedy public trial by a jury that is unbiased. The citizen should have the opportunity to see the witness of the prosecution and to present his own witnesses (Burgan 40). The seventh amendment guarantees citizens involved in suits where the value exceeds twenty dollars a trial by a jury (Burgan 41). The eighth amendment protects US citizens against unnecessarily large amounts for bail, expensive fines or cruel punishment (Burgan 41). The ninth amendment protects citizens’ rights against other rights specified in the Constitution (Burgan 41). The tenth amendment protects citizens against the federal government by only giving it rights specifically mentioned in the Constitution (Burgan 41). 2. The Magna Carta of 1215 was an important charter signed by King John of England on 15 June 1215 after barons who had become dissatisfied with the king’s exploitative form of governance and exorbitant taxes had besieged him in his palace at Windsor (Drew 139). The Magna Charter is important because it restricted the absolute powers of the king and helped t o make the parliament more powerful. Primarily, the charter was intended to modify the feudal relationships between the king and the barons in the kingdom but down the centuries the terms of the charter and the freedoms granted to citizens under it have become a cornerstone for citizens’ rights and freedoms around the world. The document became the basis of the constitutional form of government (Drew 139). Originally, the Magna Carta contained 37 laws but most of these have been lost over the centuries. The most important of the laws that is in existence today is the freedom of citizens to be protected against forcible imprisonment or possession of property by the government. Among other freedoms guaranteed by the Magna Carta were the independence of the Church and its protection against interference of any kind from the king. The Magna Carta also transferred the right to impose taxes to the parliament. Citizens were also given the right to due process and protection from arb itrary punishment and seizure (Drew 139). 3. The Magna Carta of 1215 was written by Archbishop Stephen Langton of Canterbury and was signed by King John. It was originally called Articles of the Barons. The document was signed under pressure from the feudal barons who had united against the oppressive governance of the king (Drew 139). The Bill of

Up To Interpretation Research Paper Example | Topics and Well Written Essays - 250 words

Up To Interpretation - Research Paper Example The modern era of artwork has seen a fundamental shift in the means by which the public interacts with art. Whereas before, the artwork was somewhat straight forward and readily discerned, the artwork of the modern period has left a great deal more up to personal interpretation; choosing to exploit the constructivism that has defined so much of our modern era. As a means of fully appreciating such a reality, one has to question the true nature of art: whether its subjectivity is an overall strength or an overall weakness. According to Janoaro and Altshuler, â€Å"The treasure of art, however, is that its reality lives on after its subjects die. The final product is an addition to reality, not simply a way of reproducing it†. As such, it is the strong belief of this observer that Janoaro and Altshuler have perfectly encapsulated the heart of the matter regarding art and its appreciation. Rather than confining art to a type of fantasy in which one must only appreciate within the garb of tired convention and conformity, the availability of modern art to allow for a type of constructivism and subjectivity is one of the greatest developments that art has seen come to fruition over the past 100 years. Due to the introduction of this level of subjectivity, art has been able to mean more to individuals who may otherwise have never had an interest in the convention. Moreover, it has provided for a type of open mindedness that has allowed the arts to grow and develop in ways and at a rate.

Enlightenment And Religion Essay Example | Topics and Well Written Essays - 500 words

Enlightenment And Religion - Essay Example Holy Bible was the last word and everything about a man was God-centric, God-decided, and God-given. KANTIAN CONCEPT: Enlightenment was an effort to break through this stagnant cultural context into the freedom of reason and knowledge. That’s why the German philosopher Immanuel Kant called enlightenment as the great leap forward for the humanity. â€Å"For Kant, Enlightenment was mankind’s final coming of age, the emancipation of human consciousness from an immature state of ignorance and error†¦Ã¢â‚¬ ¦.. Sapere Aude (dare to know) was Kant’s watchword taken from the Greek poet Horace† (Roy Porter, The Enlightenment, PP1). For Kant Enlightenment was an intellectual liberation; a release from man’s self-imposed tutelage. Because of this tutelage man was not able to understand the realities around him without the guidance of a super intellectual guardian. The situation is self-imposed not because the man had no intelligence but because he was not able to use the intelligence. Getting out of the intellectual dependence of the other was what Kant professed. Enlightenment was an intellectual movement. It was mostly a middle-class movement against the hereditary aristocracy and religion; a movement for the humanity in general and for the common man in particular. Though this movement is often associated with the 18th century, the roots of it go back further. Thinkers and writers who thought about the betterment of human life and society, who wanted to place ‘Reason† in the center of all human intellectual activity, who wanted to fight the tyrannical political system, and combat superstition and ignorance were trying to enlighten the people around them. Putting reason in the center of human inquiry opened the door to scientific curiosity and inquiries. Though the church could stop Galileo, they couldn’t stop the development of scientific ideas.
